Jonathan Martinez was 5 years old

Jonathan's father, Richard Martinez, told The Post that the family was coming home from the park and that Jonathan was with his father and siblings when the driver turned. He remembered his son as a very happy child who loved God and publicly asked the driver to surrender.

After the arrest, Jonathan's mother, Jennifer Erez, told the Daily News that the family wanted justice and was grateful police had a suspect in custody.

Police arrested Xavier Carchipull weeks later

Police said they arrested Xavier Carchipull, 40, on Sept. 21, 2022. The Post reported that police alleged he was behind the wheel of a 2018 Dodge Ram 1500 and charged him with leaving the scene resulting in death, aggravated unlicensed operation, and operating a motor vehicle without inspection, insurance or registration.

Published accounts agree that the driver made a left turn, but they describe the route differently. The Daily News initially reported the driver was turning left onto McIntosh Street, while later reports described police allegations that placed the driver on McIntosh Street or 100th Street before the turn.
