Authorities alleged intoxication and charged the driver

Police said Khan was intoxicated, with bloodshot and watery eyes and the smell of alcohol on his breath, according to the Daily News account of the criminal complaint. The Post reported that police said his blood alcohol concentration was .08 or more when officers took him into custody.
