What We Know
On Aug. 21, 2023, Kadeem Davis, 32, was riding a 2023 JiaJue gas-powered moped on the Cross Bronx Expressway service road when, police and prosecutors said, SUV driver Brehisly Jimenez Gonzalez pursued him after a dispute. The city crash record lists one motorist death, a moped and an SUV, and unsafe speed at Cross Bronx Service Road N and Olmstead Avenue. News accounts placed the crash near Gleason Avenue and reported that medics took Davis to Jacobi Medical Center, where he died. Published accounts described the driver's contact with Davis differently over time: police initially said the SUV driver hit him, later said he did not, and prosecutors then alleged Gonzalez swerved and rear-ended Davis during the chase.
A chase preceded the fatal moped crash
The city crash record says a 32-year-old male moped driver died after a 2:09 p.m. crash on Aug. 21, 2023, involving a moped and an SUV on Cross Bronx Service Road N at Olmstead Avenue.
Daily News reports citing police said Davis and Gonzalez argued before Davis rode west on the service road and Gonzalez pursued him. Reports said Davis made a sharp turn near Gleason Avenue, was thrown from the moped and was taken to Jacobi Medical Center, where he died.
Investigators and prosecutors focused on speed and pursuit
The city record lists unsafe speed for both involved drivers and aggressive driving or road rage for the driver in the SUV.
Prosecutors alleged Gonzalez pursued Davis at a high rate of speed after a dispute, swerved and struck the rear of Davis' scooter; police said Davis hit the curb with the moped and was flung into a light pole.
Public accounts changed on whether the driver made contact
On the day of the crash, the Daily News reported that police said the SUV driver slammed into Davis. The next day, the paper reported that police had determined Gonzalez did not strike the black moped and arrested him for leaving the scene.
Two days later, prosecutors alleged in a criminal complaint that Gonzalez swerved and hit the rear of Davis' scooter during the pursuit, leading to a manslaughter charge.
Kadeem Davis and the driver accused in court
Friends remembered Davis as kind, easygoing and generous. Schuchanna Adlam told the Daily News he was a jokester and a great father who lived for his kids.
Police arrested SUV driver Brehisly Jimenez Gonzalez, 22, after he fled onto the Cross Bronx Expressway and officers pulled him over a short distance away, according to reports. Prosecutors charged him with manslaughter, assault, reckless driving and leaving the scene; an earlier report also said he faced a no-insurance charge.
A Cross Bronx service-road corridor
